TERMS OF SALE POLICY
1. Introduction
1.1 These Terms of Sale (“Terms”) govern the purchase of jewellery and related products (“Products”) from De Vere Brilliance Limited (“we”, “us”, “our”) through our website.
1.2 By placing an order, you agree to be bound by these Terms. Please read them carefully before ordering.
1.3 These Terms apply to consumer purchases. Business-to-business sales are subject to separate contractual terms.
2. Products
2.1 All Products are described and displayed as accurately as possible, including size, weight, precious metal fineness, and gemstone disclosure.
2.2 All laboratory-grown diamonds are expressly disclosed as such in accordance with ISO 18323 and CIBJO guidelines. Any post-growth treatments are also disclosed.
2.3 Images are for illustrative purposes only. Colour, clarity, and proportions may vary slightly.
2.4 Customised, bespoke, or engraved items may not be returned unless faulty.
3. Pricing & Payment
3.1 Prices are stated in GBP and are inclusive of VAT (where applicable). Delivery charges and any duties/taxes for international orders will be shown separately before checkout.
3.2 We may change prices at any time, but confirmed orders will not be affected.
3.3 Payment must be made in full at the time of ordering through our approved payment providers.
3.4 Fraudulent, suspicious, or unauthorised transactions will result in order cancellation.
4. Orders & Contract Formation
4.1 Your order constitutes an offer to purchase.
4.2 We will confirm acceptance of your order via email, at which point a binding contract forms.
4.3 We reserve the right to refuse or cancel orders for reasons including but not limited to:
Product unavailability
Pricing errors
Payment issues
Breach of these Terms
5. Delivery
5.1 Delivery times are estimates only; delays may occur due to high demand, supply issues, or events outside our control.
5.2 Risk in the Products passes to you upon delivery, but legal title remains with us until payment in full is received.
5.3 We are not liable for delays caused by customs clearance or local delivery issues outside the UK.
6. Returns & Cancellations
6.1 Consumers have a 14-day statutory right to cancel from the date of delivery, except for items listed in 6.3.
6.2 To cancel, you must notify us in writing (email accepted). You then have 14 days to return the item. Refunds will be processed within 14 days of receiving returned goods.
6.3 Exceptions: Bespoke, customised, resized, or engraved items cannot be cancelled or returned unless faulty.
6.4 Returned items must be unused, in original condition, and with security tags and packaging intact.
7. Faulty or Misdescribed Goods
7.1 You are entitled to a full refund, repair, or replacement for faulty or misdescribed goods, in line with the Consumer Rights Act 2015.
7.2 We may request evidence (photographs, certificates, etc.) and reserve the right to verify defects before offering a remedy.
8. Product Certification & Disclosure
8.1 All laboratory-grown diamonds are supplied with disclosure documentation.
8.2 Precious metals are hallmarked in accordance with the UK Hallmarking Act 1973.
8.3 Certificates of authenticity/quality are issued where applicable.
9. Warranties & Repairs
9.1 We warrant that our jewellery will conform to its description and be free from material defects for 12 months from delivery.
9.2 This warranty excludes normal wear and tear, accidental damage, misuse, alteration, or repair by unauthorised parties.
9.3 After the warranty period, repairs may be offered at our discretion for a fee.
10. Liability
10.1 We are not liable for:
Losses arising from misuse, accident, negligence, or failure to follow care instructions
Indirect, consequential, or economic loss
Delays caused by events outside our control
10.2 Nothing in these Terms limits liability for death, personal injury, fraud, or other liability which cannot be excluded under UK law.
11. Events Beyond Our Control
11.1 We are not liable for failure to perform where caused by events beyond our reasonable control (force majeure), including natural disasters, strikes, pandemics, or supply chain interruptions.
11.2 If such events continue for more than 30 days, either party may cancel the affected order.
12. International Customers
12.1 Customers outside the UK are responsible for customs duties, taxes, and compliance with local laws.
12.2 We cannot guarantee that Products comply with laws outside the UK.
13. Intellectual Property
13.1 All website content, logos, and designs remain our intellectual property. You may not reproduce, copy, or use them without prior written consent.
14. Complaints & ADR
14.1 Complaints should be sent to hello@deverebrilliance.com. We will aim to resolve complaints within 5 working days.
14.2 If unresolved, you may refer your dispute to an Alternative Dispute Resolution (ADR) provider. Details will be supplied upon request.
15. Governing Law & Jurisdiction
15.1 These Terms are governed by English law.
15.2 Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Updates to These Terms
16.1 We may update these Terms to reflect legal, regulatory, or business changes. The version in force at the time of your order will apply.
